A U.S. district court in Florida has issued a temporary restraining order at the FTC's request, halting the operations of these entities, which allegedly caused significant financial harm to consumers.
The complaint filed by the FTC claims that Top Healthcare Options Insurance Agency Inc and 11 related defendants operated a scheme that misled consumers seeking comprehensive health insurance. Instead of providing genuine health insurance, the plans marketed by these defendants were found to be inadequate, leaving consumers vulnerable to high medical costs.
According to the FTC, the defendants targeted individuals searching for health insurance online, presenting misleading information that suggested they were offering comprehensive plans. The websites promoted terms like 'Affordable Care Act Plans' and 'Obamacare Health Insurance Carriers,' but were actually designed to collect personal information for telemarketing purposes.
The FTC's complaint details how the defendants misrepresented their products, falsely claiming that the limited benefit plans they sold were equivalent to comprehensive health insurance. They allegedly misled consumers about the extent of coverage, including specific medical services and costs, which resulted in unexpected out-of-pocket expenses for buyers.
The FTC has charged the defendants with violating the Telemarketing Sales Rule and the FTC Act, seeking refunds for affected consumers and other forms of relief.
