CNMC Reviews Enagás' Compliance with Functional Separation Criteria
The Spanish competition authority, CNMC, is analyzing whether Enagás GTS is adhering to functional separation criteria to ensure neutrality in its regulated activities.

The Comisión Nacional de los Mercados y la Competencia (CNMC) is conducting a continuous review of Enagás' compliance with functional separation criteria. This analysis is crucial to ensure that regulated activities are conducted independently from other business operations within the same corporate group.
Functional separation is designed to prevent conflicts of interest and ensure that decisions are made impartially. The CNMC monitors this compliance by reviewing internal organization, codes of conduct, incentive systems, and measures to protect sensitive information.
In its recent report, the CNMC confirmed that Enagás has met most of the required actions and recommendations from a previous report, with only two recommendations remaining unfulfilled. The authority also noted that Enagás has implemented additional measures to enhance the separation of activities.
These additional measures include modifying the Separation Policy to apply functional separation principles to new activities, such as hydrogen transport infrastructure. The CNMC also oversees compliance measures affecting Red Eléctrica de España (REE) to ensure independence in their operations.
While Enagás has made significant progress, the CNMC highlighted that certain recommendations, such as not sharing strategic services between technical management and transport, have not been fully implemented. The authority emphasizes the importance of maintaining neutrality and independence in managing consultations related to renewable gases.
