Greek Competition Authority Conducts Surprise Inspections in Passenger Transport Sector

The Greek Competition Authority (ΕΑ) has conducted surprise on-site inspections at the facilities of businesses and associations involved in the provision of passenger transport services using public taxis. This action is part of an investigation into complaints and a related ex officio inquiry.
The investigation focuses on possible horizontal and/or vertical agreements, coordinated practices, or decisions by business associations that may obstruct, restrict, or distort competition. It also examines potential abusive exploitation of a dominant market position, in violation of Articles 1 and 2 of Law 3959/2011 on 'Protection of Free Competition' and Articles 101 and 102 of the Treaty on the Functioning of the European Union (TFEU).
It is important to note that the inspections do not imply that the businesses or associations involved have engaged in anti-competitive behavior, nor do they pre-judge the outcome of the investigation.
The ΕΑ, as the guardian of the proper functioning of the free market, is responsible for enforcing competition rules based on Law 3959/2011 and Articles 101/102 TFEU. The authority emphasizes that it will prioritize interventions where necessary and will examine any relevant cases that come to its attention, including complaints, leniency applications, or anonymous tips through a secure digital environment.
The ΕΑ's leniency program offers significant advantages for businesses and individuals involved in cartel-like agreements, including total or partial immunity from administrative fines, elimination of criminal liability for responsible individuals, and exemption from exclusion from public tenders for three years following a decision.
