The New Zealand Commerce Commission has published a statement of preliminary issues concerning Woolworths Group Limited's application to acquire 100% of Beak & Johnston Holdings Pty Ltd. This statement highlights the key competition issues that the Commission will consider in its decision-making process regarding the proposed acquisition.

The Commission is seeking input from interested parties on the competitive effects of the acquisition. Comments can be submitted via email to the Commission, with a deadline set for close of business on 24 February 2025. The Commission plans to make a decision on the application by 12 March 2025, although this date may be extended if necessary.

According to the Commission, clearance for a merger will only be granted if it is satisfied that the merger is unlikely to substantially lessen competition in any market within New Zealand. Further details on how the Commission evaluates merger applications are available on their official website.
