The Norwegian competition authority, known as Konkurransetilsynet, has officially launched a new tool called 'markedsetterforskning' to strengthen competition in the country's markets. This initiative allows the authority to implement targeted measures to address serious competition issues, even in cases where there are no direct breaches of competition law.

Acting Director Gjermund Nese emphasized that this marks a significant shift in Norwegian competition policy. The new tool enables earlier and more precise interventions, benefiting both consumers and businesses. A market investigation can be initiated if the authority identifies conditions that suggest competition in a market is, or is at risk of becoming, significantly restricted.

Before commencing a market investigation, a hearing will be conducted to allow affected parties and stakeholders to provide input. Following this, a thorough analysis phase will take place, where the authority will gather information, assess competitive conditions, and identify any structural or behavioral challenges within the market. If significant competition problems are uncovered, Konkurransetilsynet can impose targeted measures to enhance competition.

This market investigation tool is positioned alongside enforcement and advocacy efforts, with the specific competition issue determining which tool is most effective. The authority has not yet decided which markets will be prioritized for these investigations, opting instead to carefully evaluate where the need is greatest and how the tool can be utilized most effectively.

When a market investigation is initiated, the process will be as open and transparent as possible to ensure predictability for businesses and to resolve any competition issues in the best manner possible. Project leader and senior advisor Inger Ervik stated that the tool will be used cautiously and with professional integrity, allowing for measures to strengthen competition only after thorough analyses and evaluations.
