The Netherlands Authority for Consumers and Markets (ACM) has intervened in the practices of a medical alert system provider, Persoonsalarmering B.V., which sells subscriptions to seniors through door-to-door sales. The company will compensate consumers who purchased these systems between January 1, 2022, and August 31, 2024, and will allow them to cancel their subscriptions without charge.
ACM's investigation was prompted by reports of aggressive sales tactics, unclear pricing, and unfair cancellation conditions. The authority found that the company's door-to-door sellers pressured potential customers, particularly vulnerable seniors, into making quick decisions, often using fear-based tactics. Additionally, the sellers provided misleading information regarding unsubscribe fees and the terms for early cancellation.
In response to ACM's findings, the company has committed to several changes, including reimbursing consumers who paid unsubscribe fees, clarifying cancellation terms, and improving its complaint-handling process. The company will also ensure that its sales practices comply with consumer protection regulations and will provide training to its staff to prevent improper pressure on customers.
ACM will monitor the company's compliance with these commitments over the coming months, ensuring that the provider honors its promises to consumers. The authority emphasizes the importance of protecting vulnerable populations in business practices.
