03.08.2025 | Polish Competition Authority (DKK)

The Polish Competition Authority (DKK) issued Decision No DKK-189/2025 on August 4, 2025, approving the merger between R.Power Investment B.V., based in Amsterdam, and SunPol Capital SAS, based in Paris. The merger involves the creation of a joint venture called Elektrownia PV Lasocice sp. z o.o., located in Warsaw.

The decision was made following an antitrust investigation initiated at the request of the merging parties. The authority determined that the merger would not raise any competition concerns and thus granted approval without the need for further justification, as the request was fully compliant with the legal requirements.

As per the Polish competition law, the decision allows the parties to proceed with their plans without imposing any remedies or conditions. The authority also noted that the decision does not resolve any disputes between the parties and was not made in response to an appeal.
