Canada's Competition Bureau Releases Updated Guidance for Market Studies

The Competition Bureau of Canada has published a new Market Studies Information Bulletin, providing updated guidance on conducting market studies following a public consultation.


On May 20, 2025, the Competition Bureau of Canada released the final version of its Market Studies Information Bulletin, which follows a public consultation on a draft version. This Bulletin aims to enhance understanding of competition dynamics in key sectors of the Canadian economy and to support policymakers in making informed decisions.

The Market Studies Information Bulletin addresses five key questions regarding the Bureau's approach to market studies: the preparatory steps before launching a study, the process of launching and determining the duration of studies, methods for obtaining and utilizing information (including confidential data), expected outcomes of market studies, and the follow-up and monitoring of their impacts.

Recent amendments to the Competition Act in December 2023 have established a new framework for conducting market studies, which includes enhanced information-gathering powers. These changes are incorporated into the new Bulletin, which replaces the previous version from 2018.

While the Bulletin provides guidance and transparency, it is not a legal document. The Commissioner of Competition is required to consult with the Minister of Industry before initiating a market study, and the Minister can also direct the Commissioner to conduct a study if deemed necessary for public interest. It is important to note that market studies are not law enforcement investigations; however, if illegal activities are suspected, the Bureau will take appropriate action.
