CNMC Proposes Reforms for Professional Engineers' Statutes

The Spanish competition authority, CNMC, has proposed improvements to the statutes governing the Official Colleges of Industrial Engineers, emphasizing the need for a comprehensive reform of professional service regulations.

The Comisión Nacional de los Mercados y la Competencia (CNMC) has reviewed a draft Royal Decree aimed at updating the General Statutes of the Official Colleges of Industrial Engineers. This new regulation seeks to replace the existing Royal Decree 1332/2000 and adapt the legal framework to recent regulatory and procedural changes.

While the CNMC supports the initiative for statutory reform, it stresses the necessity for a comprehensive review of professional service regulations, a commitment that has been pending for over a decade. The CNMC has highlighted the importance of addressing a global reform to eliminate unjustified barriers to access and practice within these professions.

Several areas for improvement have been identified by the CNMC. It urges the College to amend its statutes to allow only for the creation of 'guiding criteria' rather than fixed fee schedules for judicial expert professionals. Additionally, it recommends that the statutes explicitly state that decisions and recommendations from collegiate bodies must comply with competition law.

Furthermore, the CNMC suggests that the pricing of visa services should be linked solely to the administrative costs of processing, ensuring efficient management. It also calls for legislative action to effectively develop existing registration obligations from a good regulation perspective, and it emphasizes that the College should not be tied to a professional address beyond initial registration.
