The Italian Competition Authority has renewed its memorandum of understanding with the Public Prosecutor’s Office of Milan to strengthen cooperation against corruption and improve market functioning.


The Italian Competition Authority, led by Chairman Roberto Rustichelli, has signed a renewed memorandum of understanding with Milan’s Public Prosecutor, Marcello Viola. This agreement aims to enhance collaboration in preventing and addressing corruption within the Public Administration while promoting a well-functioning market.

This updated memorandum builds on a previous agreement established in 2018, reinforcing the commitment to share information and resources effectively. It sets a clear operational framework for both parties to exchange relevant information regarding ongoing investigations and administrative proceedings.

Under the new terms, the Italian Competition Authority is obligated to promptly provide the Public Prosecutor’s Office with any requested information or documents during investigations, especially when enforcement activities reveal potential criminal conduct. Conversely, the Public Prosecutor will share unrestricted investigation documents that pertain to criminal offenses impacting market integrity and consumer interests.

A significant aspect of this memorandum is the cooperation regarding the Authority’s new powers to conduct inspections beyond corporate premises, including private residences of key personnel. The agreement outlines the procedure for obtaining prior authorization from the Public Prosecutor’s Office for such inspections, ensuring legal compliance and respect for jurisdiction.

This memorandum is set to remain in effect for five years, with provisions for tacit renewal. Its implementation will be reviewed annually to ensure effectiveness and adherence to its objectives.
