Competition Authority Fines Companies for Price Fixing in Baby Products

The Competition Authority has imposed reduced fines on three companies for engaging in resale price maintenance practices in the baby products market, totaling €314,389.

The Competition Authority (ΕΑ) has issued a unanimous decision (No. 870/2024) regarding an investigation into companies involved in the marketing of breast milk pumping and storage products, baby feeding items, strollers, and car seats. The decision follows a dispute resolution process initiated by the companies B.KAI M.SKARMOUTSOS - CHILDREN'S GOODS TRADE S.A. (Skarmoutsos), FARMEX S.A., and PERAMAX S.A.

The investigation revealed that these companies engaged in practices of resale price maintenance within their distribution networks. They systematically monitored retail prices and pressured retailers to adjust their prices, which the retailers complied with. Such contractual terms or practices in vertical agreements that dictate resale prices are considered serious restrictions on competition under Articles 1 of Law 3959/2011 and 101 TFEU.

As a result of the dispute resolution proposals submitted by the involved companies, the Competition Authority decided to impose reduced fines: Skarmoutsos was fined €165,822, FARMEX €108,253, and PERAMAX €40,314, totaling €314,389.
