Spanish Competition Authority Closes Cases Against Parking Concessionaires
The Spanish competition authority, CNMC, has closed two investigations into Empark and Eysa for alleged abuse of market dominance, finding insufficient evidence of wrongdoing.

The Comisión Nacional de los Mercados y la Competencia (CNMC) has decided to archive two sanctioning files against Empark and Eysa, which were investigated for potential abuse of their dominant position in the regulated parking sector.
Both companies hold municipal concessions for managing regulated parking, while EasyPark provides mobile application services for payment in over 100 Spanish municipalities. EasyPark had accused Empark and Eysa of hindering access to necessary technological platforms for mobile payment services in cities like Toledo, Manzanares, Algemesí, and Pozuelo de Alarcón.
In August 2024, the CNMC initiated investigations based on these allegations, focusing on a possible infringement of Article 2 of the Competition Defense Law. However, after reviewing the evidence, the CNMC concluded that there was not enough proof to establish abusive exclusionary conduct by Empark and Eysa.
While the current cases have been closed, the CNMC emphasized that any future similar conduct will be examined on a case-by-case basis, ensuring compliance with competition law.
