This decision arises from concerns that the merger could significantly impact competition within the civil-engineering sector.
ACM's preliminary findings indicate that the acquisition may lead to reduced competition, which could result in higher prices and fewer choices for clients. The authority has pinpointed three critical areas of concern: the tender processes for large civil-engineering projects, asphalt production, and asphalt milling.
In the context of large construction projects, both Boskalis and VolkerWessels are key competitors in bidding for significant road and infrastructure projects. The merger could consolidate their market power, adversely affecting public clients and other construction firms. Public clients have expressed worries about limited options and potential price hikes for large projects, while other construction companies fear diminished collaboration opportunities.
Moreover, the acquisition would strengthen Boskalis and VolkerWessels' positions in the asphalt production market across major Dutch cities, raising concerns about increased prices and reduced supply for road construction companies.
