Austrian Construction Company Fined EUR 1.3 Million for Participating in Cartel Activities

The Austrian Competition Authority successfully imposed a fine of EUR 1.3 million on STEINER BAU for engaging in cartel activities related to price fixing, market allocation, and information exchange in public and private construction projects.

STEINER BAU was found to have participated in cartel activities from at least December 2005 to June 2017, involving price agreements, market sharing, and information exchange with competitors in construction projects in specific regions of Austria.

The cartel primarily affected the road construction sector across Austria, targeting both public and private clients, with ongoing investigations by the competition authority and some cases already concluded.

Companies involved in the cartel made agreements to secure contracts, maintain market shares, and ensure capacity utilization through practices such as price fixing, market allocation, and forming anti-competitive consortia.

Under the Austrian Competition Law, behaviors that distort competition, like price fixing and market division, are prohibited, with fines of up to 10% of the company's previous year's total revenue possible based on the severity, duration, fault, financial capability, and cooperation of the company.
