The Polish competition authority, UOKiK, has taken decisive action against companies in the renewable energy sector, highlighting issues of unfair practices that mislead consumers. The authority has charged four firms: EPG, Revolt Energy, PEGK, and Centrum Dotacji OZE, while imposing a fine exceeding one million PLN on Sunday Polska.
UOKiK President Tomasz Chróstny emphasized the importance of fair practices in the rapidly growing renewable energy market. He stated that while the transition to renewable energy offers opportunities for cost savings and environmental benefits, it also attracts companies that exploit consumer inexperience and trust. The authority is committed to intervening against unfair contract terms and aggressive marketing tactics.
EPG, now known as Energia Plus Gaz, faced scrutiny for contract terms that heavily favored the company, including penalties for consumers who wished to withdraw from contracts after 14 days. Similar issues were found with Revolt Energy, which retained deposits and imposed additional charges on consumers.
PEGK and Centrum Dotacji OZE were accused of using misleading marketing tactics, including sending out documents that resembled official government notices to pressure consumers into signing contracts. Centrum Dotacji OZE also engaged in unsolicited telemarketing practices, violating consumer consent.
Sunday Polska was fined for contract terms that restricted consumer rights and imposed excessive penalties for delays, which were often attributed to weather conditions. The fine imposed by UOKiK amounts to 1,011,516 PLN, although the decision is not yet final.
