Nextbike Poland, a leading operator of city bike systems, was found to have used abusive clauses in contracts with consumers and made unauthorized changes to its terms and conditions, resulting in consumers being unfairly charged additional fees. The President of UOKiK imposed a fine of over 791,000 PLN on Nextbike Poland. The company must pay the fine, inform consumers of the decision, and consumers have the right to seek redress in court. The changes to the terms and conditions were communicated to consumers via email, with silence implying acceptance, and refusal leading to contract termination, disrupting the balance of obligations between the parties.
