The Polish competition authority (UOKiK) is investigating whether businesses offering condo and aparthotel units are providing complete and accurate information to consumers. This scrutiny comes as part of a broader effort to protect consumer rights in the real estate investment sector.

UOKiK has initiated ten investigative proceedings based on marketing communications and sales materials related to these investments. The authority aims to determine if investors are being adequately informed about the risks and conditions associated with purchasing these commercial properties, which are often marketed as lucrative investment opportunities.

The investigations focus on various projects, including apartments in Świeradów, the Mercure Szczyrk Resort, and several others. UOKiK is analyzing information available on websites and sales brochures, as well as contracts with developers and operators of these properties.

Concerns have been raised about the potential for misleading marketing practices that emphasize the benefits of these investments while downplaying associated risks, such as seasonal rental fluctuations and maintenance costs. UOKiK's President, Tomasz Chróstny, has urged consumers to thoroughly review investment offers and be cautious about unrealistic profit expectations.

This investigation follows previous actions by UOKiK, including warnings about the risks of investing in aparthotels and condohotels, and decisions against companies that misled consumers regarding investment safety and profitability.

Additionally, UOKiK has imposed fines on Termy Uniejów for including prohibited clauses in contracts and providing false information about expected profits to potential investors. These decisions highlight the authority's commitment to enforcing consumer protection laws in the real estate sector.
