Kaufmann and two executives have been fined for engaging in illegal information exchange with their supplier, Hugo Boss. The exchange of information, including prices, was found to violate competition rules due to Hugo Boss being an active competitor in the same market.
The case highlights the importance for companies to exercise caution when sharing information with suppliers who are also competitors in the market.
The violation took place between January 2014 and November 2017, as part of a larger complex involving Hugo Boss sharing information with retailers Kaufmann and Ginsborg about prices, discounts, and quantities for future sales.
Previous rulings by the Competition Council, the Competition Appeals Board, and the Maritime and Commercial Court have confirmed the illegality of the information exchange.
