The New Zealand Commerce Commission has published a Statement of Unresolved Issues concerning Rafting JV Co's application to acquire the rafting and sledging assets of Rotorua Rafting, Kaitiaki Adventures, and Kaituna Cascades.
This statement outlines the Commission's initial findings and potential competition issues that may arise from the proposed acquisition. It is important to note that this statement does not represent a final decision, nor does it indicate whether the Commission will ultimately approve or deny the merger.
The Commission is actively seeking feedback from the involved parties, including Rotorua Rafting, Kaitiaki Adventures, and Kaituna Cascades, as well as any other interested stakeholders. Submissions regarding the issues raised in the Statement of Unresolved Issues are encouraged.
Interested parties can submit their comments via email, with a deadline set for close of business on 14 May 2026. Additionally, cross-submissions will be accepted until 25 May 2026. The Commission aims to reach a decision on the merger application by 18 June 2026, although this timeline may be adjusted if necessary.
The Commission's clearance for any proposed merger hinges on its assessment that the merger will not substantially lessen competition in the relevant market.
