The European Commission has opened a formal investigation into SAP, a leading software provider, regarding its practices in the maintenance and support services market for its on-premises ERP software. The investigation, initiated on September 25, 2025, preliminarily found that SAP may be abusing its dominant position, potentially violating EU competition laws.

SAP's ERP software is crucial for managing various business operations, and the company also offers maintenance and support services. However, the Commission has identified several practices that may restrict competition, including requiring customers to use SAP exclusively for maintenance services and preventing them from terminating support for unused licenses.

In response to these concerns, SAP has proposed commitments aimed at increasing competition and providing customers with more flexibility. These commitments include allowing customers to choose different support service suppliers, clarifying contractual terms regarding support contracts, and reducing fees associated with resuming support services.

The Commission will assess the feedback from interested parties on these commitments, which, if made binding, will apply globally for a period of ten years. The implementation of these commitments will be monitored to ensure compliance.
