The Polish competition authority, UOKiK, has intervened to require Apple to modify its practices regarding mobile app developers in Poland. This decision aims to create a fairer competitive environment and enhance consumer awareness about data processing.
UOKiK's President, Tomasz Chróstny, highlighted that Apple, while producing electronic devices, also sets rules for app developers, which can lead to potential abuse of its dominant market position. The authority's investigation was prompted by concerns over Apple's App Tracking Transparency (ATT) policy, which could have restricted app developers' access to user data.
Under the ATT policy, Apple defined 'tracking' in a way that favored its own applications over those of independent developers, potentially discouraging users from sharing their data with third-party apps. This led to a competitive imbalance, as Apple could utilize its own data for advertising without requiring additional consent.
As a result of the investigation, Apple is now required to implement changes that will benefit both app developers and consumers. The new rules will ensure that users receive clear and unbiased information regarding how their data is used, allowing for more informed consent decisions.
Additionally, Apple must establish mechanisms to resolve disputes with app developers, including appointing an independent liaison officer to handle complaints. These changes are expected to be implemented within two months of the decision becoming final.
UOKiK's actions reflect a broader scrutiny of big tech companies and their practices, with ongoing investigations into similar issues involving Google and Meta.
