FTC Proposes New Rules to Address Hidden Rental Housing Fees

The Federal Trade Commission has submitted a draft proposal to regulate deceptive fees in the rental housing market, aiming to enhance transparency for consumers.

The Federal Trade Commission (FTC) has announced the submission of an Advance Notice of Proposed Rulemaking (ANPRM) concerning fees in the rental housing market to the Office of Information and Regulatory Affairs (OIRA) for review. This action is in compliance with Executive Orders 12866 and 14215, which mandate that significant regulatory actions undergo OIRA review.

FTC Chairman Andrew N. Ferguson emphasized the need for transparency in housing rental agreements, stating that consumers have been unfairly burdened by hidden fees and deceptive practices. The proposed rule aims to solicit public comments on the necessity of new regulations to prevent such unfair fees from being imposed on renters.

Ferguson highlighted that the FTC has the authority to create rules that support the enforcement of laws against unfair trade practices, which could enhance the agency's ability to take action against violators. This initiative aligns with the President's focus on reducing living costs and improving affordability in the housing market.

The Commission's vote to refer the ANPRM to OMB was unanimous, with a 2-0 decision. Annette Soberats from the FTC’s Bureau of Consumer Protection is leading this matter.
