Dutch Authority Delays Decision on Apple's App Store Fees Amid EU Discussions

The Dutch competition authority, ACM, has postponed its decision regarding Apple's commission fees for dating app providers due to ongoing discussions with the European Commission. A final decision is expected before April 1, 2026.

The Netherlands Authority for Consumers and Markets (ACM) has decided to hold off on enforcing its order regarding Apple's commission fees for dating app providers. This decision comes as Apple is currently engaged in discussions with the European Commission about its fees, which have recently been adjusted.

ACM aims to prevent overlapping conversations on the same issue, and it will reassess the situation once there is more clarity on Apple's fee structure. The authority has set a deadline of April 1, 2026, to determine whether further action is necessary against Apple.

In June 2025, the District Court of Rotterdam upheld ACM's 2021 ruling that Apple had abused its dominant position by imposing unreasonable conditions on dating app providers. The court confirmed that Apple must comply with ACM's order to cease these practices, which included high commission rates and restrictions on payment options. Although the compliance deadline was initially set, ACM has now extended it to allow Apple time to make necessary adjustments.

The Digital Markets Act (DMA), effective since March 2024, aims to enhance competition in European digital markets and ensure fair conditions for platforms like Apple's App Store. The European Commission has already indicated that Apple did not comply with the DMA regarding certain conditions for app providers, leading to fines and further adjustments by Apple.

ACM is focused on protecting consumers and businesses from market power abuses in the digital economy. The authority has the power to conduct investigations and impose sanctions, including fines, to address such abuses.
