A project of Real Decreto is being developed to implement Spain's e-invoicing system, as mandated by the Law 18/2022 aimed at fostering business creation and growth.

The CNMC recommends thorough justification for why the public e-invoicing solution is the most suitable, highlighting concerns about market distortions and unequal access to information.

The law requires electronic invoicing in all commercial transactions between businesses and self-employed individuals, with the Real Decreto outlining minimum interoperability requirements and security standards for e-invoicing technology providers.

The CNMC's consultative role allows it to provide recommendations on ensuring fair competition and efficient regulation in the e-invoicing market, emphasizing the importance of considering alternative syntax formats for e-invoices.
