Croatian Competition Authority Fines DECENTIA d.o.o. for Unfair Trading Practices

The Croatian competition authority has imposed a €60,000 fine on DECENTIA d.o.o. for violating laws against unfair trading practices in the food supply chain.

The Croatian Competition Authority (AZTN) has fined DECENTIA d.o.o., based in Zagreb, €60,000 for serious violations of the Law on Prohibition of Unfair Trading Practices in the Food Supply Chain (ZNTP).

AZTN initiated an administrative procedure against DECENTIA d.o.o. to determine whether the company was imposing unfair trading practices on its suppliers of agricultural and food products by exploiting significant bargaining power.

Following the administrative procedure, AZTN found that DECENTIA d.o.o. had indeed used its significant bargaining power to impose unfair trading practices, including operating under contracts that lacked clear terms regarding price, quality, and delivery conditions, and unreasonably delaying payments for perishable goods.

The fine of €60,000 was determined by considering the severity, scope, duration, and consequences of the violations for suppliers, along with several mitigating circumstances. AZTN believes that this penalty will deter not only DECENTIA d.o.o. but also other entities from violating the ZNTP.
