Lithuanian Competition Council Declines Investigation into Lietuvos Paštas Pricing Practices

The Lithuanian Competition Council has decided against initiating an investigation into AS Lietuvos Paštas regarding allegations of abuse of a dominant market position. This decision follows a complaint from Unifiedpost, which claimed that Lietuvos Paštas engaged in predatory pricing during a public procurement process.
Unifiedpost alleged that Lietuvos Paštas offered services at unreasonably low prices, including some for EUR 0, which they argued constituted a breach of previous commitments made to the Competition Council. However, the Council found that the pricing strategy was applied in a single instance and did not indicate a systematic approach to predatory pricing.
After reviewing the situation, the Competition Council concluded that the pricing practices in question did not significantly impact competition or consumer welfare. They emphasized that the assessment of the entire service package, rather than individual components, was crucial in their decision-making process.
Furthermore, the Council noted that Lietuvos Paštas is considering changes to its pricing methodology to promote fair competition. The Council's Chief Advisor expressed hope that the expert assessment provided would lead to positive changes in the market.
The decision can be appealed within one month, and the Council remains open to initiating an investigation if new evidence arises.
