Public Consultation on DMA and GDPR Guidelines Launched
The European Commission and the EDPB are seeking feedback on draft guidelines that clarify the relationship between the Digital Markets Act and the General Data Protection Regulation.

The European Commission, in collaboration with the European Data Protection Board (EDPB), has initiated a public consultation to gather feedback on draft guidelines concerning the interplay between the Digital Markets Act (DMA) and the General Data Protection Regulation (GDPR).
These guidelines are designed to assist companies in understanding and complying with both regulations, particularly where they intersect. Key areas of focus include the DMA's provisions on data combination and portability, which involve the processing of personal data and thus necessitate adherence to GDPR requirements.
Additionally, the DMA introduces alternative app stores and distribution channels for applications, where gatekeepers may implement necessary measures that must also align with GDPR standards.
This collaborative effort, which commenced in September 2024, aims to enhance legal clarity and certainty for businesses operating within the EU, ensuring that both regulations are applied coherently while respecting the distinct roles of each regulatory body.
Interested stakeholders have until December 4, 2025, to provide their feedback. The final guidelines are expected to be adopted in 2026, following a thorough assessment of the collected input. After the consultation period ends, all submissions will be made publicly available on the DMA website, with a link provided on the EDPB website.
