Hungarian Competition Authority Reduces Fine for Lamp Retailer Lutec

The Hungarian competition authority has significantly reduced a fine imposed on Lutec, a lamp retailer, after the company cooperated during the investigation and acknowledged its pricing violations.

On July 9, 2025, the Hungarian Competition Authority (GVH) imposed a fine of 13.5 million HUF on Lutec Lighting Kereskedelmi és Szolgáltató Kft. for setting consumer prices during the wholesale distribution of lighting fixtures to specialized retailers. The company had threatened sanctions against retailers who did not comply with these prices, which constitutes a serious violation of competition law.

The GVH identified that Lutec's practice of imposing resale price maintenance is a significant restriction on competition. The authority noted that the company actively enforced its 'recommended' prices by threatening to withhold deliveries from retailers who deviated from these prices.

Throughout the investigation, Lutec cooperated with the GVH, provided evidence, admitted to the violation, and waived its right to appeal. In light of these corrective actions, the GVH significantly reduced the fine, ultimately imposing a penalty of 13.5 million HUF.

The GVH emphasized the benefits of cooperation with the national competition authority, stating that companies can significantly reduce fines or even avoid monetary sanctions altogether by choosing appropriate forms of collaboration. The authority also considers the size and market power of the offending company when determining penalties.

For micro, small, and medium-sized enterprises that commit violations for the first time, the GVH may issue a warning instead of a fine, provided there is adequate cooperation. However, serious violations like resale price maintenance do not exempt even small businesses from penalties.
