UOKiK Accuses Telmed Medical Center of Consumer Rights Violations
The President of the Polish competition authority has accused Telmed Medical Center of misleading consumers regarding online medical consultations and prescriptions.

The President of the Polish competition authority (UOKiK) has raised allegations against Telmed Medical Center based in Lublin for violating collective consumer interests. The accusations stem from complaints received about the company's online services, particularly through its websites e-lekarz24h.pl and e-zwolnienie24h.pl, where consumers can order electronic prescriptions and medical certificates.
One of the main issues highlighted is the misleading promotion of services, such as the claim that consumers can quickly obtain prescriptions for testosterone, despite the fact that such prescriptions are explicitly prohibited on the website. This practice may constitute unfair market behavior as it misleads consumers into believing they can access medications that require direct medical consultation.
Additionally, Telmed Medical Center has been accused of presenting only positive reviews on its platforms without verifying their authenticity. Under the new Omnibus directive, businesses must disclose whether they verify reviews and how they do so, including whether negative reviews are also published. The lack of transparency in this regard raises concerns about the authenticity of consumer feedback.
Another significant allegation involves the unclear terms regarding consumers' rights to withdraw from contracts. The company has been criticized for vague language about when and how consumers can exercise this right, leading to confusion and potential denial of withdrawal requests. If the allegations are confirmed, Telmed could face a fine of up to 10% of its revenue.
UOKiK is also investigating other entities offering e-prescriptions to determine if they are similarly violating consumer rights or using unfair contractual clauses.
