The Netherlands Authority for Consumers and Markets (ACM) has published its 2024 annual report, showcasing its commitment to ensuring that markets operate effectively for consumers and businesses. The report highlights ACM's focus on three key areas: energy, the digital economy, and sustainability, alongside a new legislative letter aimed at eliminating redundant regulations.
In the energy sector, ACM introduced measures to optimize network capacity and promote efficient energy consumption. Large-scale users who shift their consumption to off-peak hours can receive discounts of up to 65%. ACM has also placed energy suppliers under increased scrutiny, revoking the license of Hollandse Energie Maatschappij for untrustworthy practices. Furthermore, ACM advocates for a ban on telemarketing for energy contracts and encourages businesses to assist consumers in making informed choices.
In the digital economy, ACM took significant actions against misleading practices by online retailers and service providers. Notably, game developer Epic Games International was fined over 1.1 million euros for using deceptive countdown timers in its game Fortnite, pressuring children into making purchases. ACM has also reprimanded other online businesses for fake reviews and misleading discounts, while educating companies about new European digital regulations.
Regarding sustainability, ACM has enforced actions against companies making misleading sustainability claims and provided guidance on collaborative efforts to achieve sustainability goals while adhering to competition laws. The authority has initiated informal assessments of initiatives and launched a “collaboration check” to facilitate compliance.
In addition to regulatory actions, ACM conducted market studies in various sectors, including savings and health insurance, and provided recommendations to the Dutch legislature on new and existing rules. The introduction of the legislative letter marks a commitment to ongoing engagement with businesses and stakeholders in refining regulatory frameworks.
