The Polish competition authority, UOKiK, has initiated proceedings against Furgonetka, a parcel delivery service, questioning nine provisions in its terms of service. The investigation focuses on the unilateral imposition of additional fees on consumers after the delivery of packages, which may not be clearly justified.
Consumers using Furgonetka's services select a carrier and pay for the shipment through the platform. However, issues arise when additional charges are levied post-delivery, often without proper documentation or justification. UOKiK's President, Tomasz Chróstny, emphasized that consumers should be informed about any charges and that consent is necessary for additional fees.
Complaints have been received from consumers who reported unexpected charges after sending packages, with many stating they did not receive any evidence or documentation supporting the need for these additional fees. The investigation aims to determine whether the contested provisions constitute unfair contractual clauses.
Furgonetka has previously made some changes in response to complaints, such as allowing users to upload photos of their packages and providing links to carrier regulations. However, complaints about unjustified fees continue to be reported to UOKiK.
The proceedings will assess whether the nine questioned provisions are indeed unfair. If confirmed, UOKiK may declare these provisions invalid, prohibit their use, and impose fines of up to 10% of Furgonetka's annual revenue.
