On April 2, 2025, the Luxembourg Chamber of Deputies adopted a bill to implement the European Digital Services Act (DSA). This legislation designates the Luxembourg competition authority as the Digital Services Coordinator (DSC) and establishes procedures for investigation and enforcement to ensure compliance with the DSA.
The mechanisms outlined in the bill are heavily inspired by existing competition law and practices already in place by the authority and the European Commission. The authority aims to leverage its experience in competition law and has formed a dedicated team to oversee online platforms, drawing from its competition service.
Since 2022, the authority has closely monitored developments in digital market regulation. It has taken several steps to prepare and inform stakeholders, including publishing a general information page on online platform regulation, a detailed guide for digital actors, a practical guide for small and micro-enterprises, and a complaint service via MyGuichet.lu for online platform users.
Throughout 2024, the online platforms service conducted workshops to ensure effective and coherent implementation of the DSA in collaboration with national authorities. This series of workshops formalized cooperation processes through a cooperation agreement signed by eight national authorities.
Following the second vote exemption from the Council of State and promulgation by the Grand Duke, the law will come into effect four days after its publication. The competition authority hopes to quickly complete its team responsible for the online platforms service to effectively manage its new responsibilities.
The DSA aims to create a safe and responsible online environment by imposing rules on online intermediary services and additional obligations for very large platforms that reach over 10% of the 450 million consumers in Europe. As the DSC, the authority will oversee compliance for online service providers based in Luxembourg, with an estimated 240 platforms affected. The European Commission will continue to oversee compliance for very large platforms and search engines.
