Public Consultation on Reasonable Profit Reference for Railway Service Operators

The CNMC has launched a public consultation to discuss the reference of reasonable profit that will be used to oversee the prices paid by railway companies for services at stations, freight terminals, and workshops.
Access to these facilities, owned by Adif, Renfe, and other companies, is crucial for the operation of freight and passenger transport companies. The regulation stipulates that service prices must not exceed the cost of provision plus a reasonable profit.
In a recent Communication, the CNMC clarified the criteria it applies to supervise service prices, which can be initiated following a complaint. This Communication outlines the criteria for determining the costs attributable to services and develops a methodology for calculating a reasonable profit reference, including periodic updates.
The public consultation document details the values of each parameter that makes up the formula for the reasonable profit reference. Observations will be public unless stated otherwise and must be submitted through the CNMC's electronic headquarters.
