The Dutch competition authority, ACM, has finalized a definitive agreement with system operators and trade associations regarding a new regulatory method for setting tariffs for the 2027-2031 period. This agreement aims to provide stability and clarity, allowing system operators to focus on addressing grid congestion and facilitating the energy transition.
Previously, in December 2025, various stakeholders, including the trade association of system operators Netbeheer Nederland and several system operators, reached an initial agreement on this regulatory method. The recent signing of this definitive agreement marks a significant step in solidifying these arrangements, which ACM will incorporate into its final decision expected to be published on February 16.
Manon Leijten, a member of ACM's board, emphasized the importance of this agreement, stating that it enables system operators to make necessary investments to tackle grid congestion. The new method also involves deeper engagement with system users during the planning of investment strategies, ensuring that costs are kept in check.
While all parties have committed to refraining from legal actions regarding the new method, the distribution system operators retain the right to challenge the depreciation costs of their historical book value in court. This exception allows for potential legal recourse on that specific issue without affecting the overall allowed tariff revenues.
