BTP Sud Fined for Unfair Practices in Wallis and Futuna Aggregates Market

The French competition authority has imposed a fine on BTP Sud for abusing its dominant position in the aggregates supply market by imposing unfair trading conditions on the local administration.

The Autorité de la concurrence has sanctioned BTP Sud with a fine of €148,094 for abusing its dominant position in the aggregates supply market in Wallis and Futuna. This decision follows a complaint from the Prefect of the Territory regarding BTP Sud's unfair trading practices.

BTP Sud, which operates the only quarry capable of meeting local demand, refused to sell aggregates to the Administration Supérieure du Territoire and imposed unjustified price increases. These actions were aimed at obtaining concessions from the Administration related to a previous commercial dispute.

The investigation revealed that BTP Sud's refusal to fulfill its contractual obligations and the significant price hikes were not economically justified. The authority found that BTP Sud's conduct constituted an abuse of its dominant position, violating Article L. 420-2 of the French Commercial Code.

As a result, the Autorité de la concurrence has taken action against BTP Sud for its practices between June 2021 and September 2023, highlighting the importance of fair trading conditions in public procurement.
