Tereos Fined for Breach of Merger Inquiry Obligations by UK Competition Authority

Tereos has been fined £25,000 by the UK's Competition and Markets Authority (CMA) for failing to provide necessary information during a merger inquiry.

The CMA imposed a fine on Tereos for not complying with a notice requiring the production of specific documents related to its board and corporate governance in the context of the T&L Sugars/Tereos merger inquiry.

Despite responding to the notice initially, Tereos was found to have failed to provide a full response upon further investigation by the CMA, which was deemed to have a potentially adverse impact on the CMA's inquiry.

The CMA emphasized the importance of parties fully and timely complying with information requests during investigations to ensure sound decision-making that benefits consumers and the economy.

The maximum penalty for non-compliance with a notice under the Act is currently £30,000, but amendments under the Digital Markets, Competition and Consumers Act 2024 will increase this to 1% of a business's worldwide turnover.
