The Lisbon Court of Appeal has upheld the highest ever fine for abuse of dominant position, confirming EDP Produção's manipulation of the teleregulation service to benefit at the expense of consumers.

26.09.2023 | Portuguese competition authority

The Lisbon Court of Appeal has upheld the Portuguese Competition Authority's decision to fine EDP Produção 40 million euros for abusing its dominant position in the secondary regulation band market. EDP Produção manipulated the teleregulation service to increase prices and obtain higher compensation, resulting in harm to electricity consumers. This ruling sets a precedent for the highest fine for abuse of dominant position in Portugal.
