The Croatian Competition Agency (CCA) has launched a formal investigation into Tahograf d.o.o., a company based in Sveta Nedelja, following a procedural order issued on April 29, 2025. The investigation aims to determine if Tahograf has engaged in anti-competitive practices by abusing its dominant position as the authorized distributor of VDO – Kienzle brand devices and spare parts in Croatia.
The inquiry was prompted by a complaint from Urar d.o.o., located in Otočac, which alleged that Tahograf has been obstructing its access to the market for servicing VDO tachographs. Specifically, Urar claimed that Tahograf has consistently refused to enter into a necessary business and technical cooperation agreement, which is essential for obtaining a license to operate a tachograph workshop. This refusal to deal may constitute a violation of Article 13 of the Croatian Competition Act.
To gather evidence and verify the claims made in the complaint, the CCA conducted a surprise inspection at Tahograf's business premises, authorized by a warrant from the High Administrative Court of Croatia. The CCA's investigation will focus on whether Tahograf's actions amount to an abuse of dominance as defined under Article 13 of the Competition Act.
It is important to note that the initiation of this proceeding and the dawn raid do not imply any pre-judgment of the CCA's final decision regarding the case. The agency will assess all findings before reaching a conclusion on whether competition rules have been violated.
