The Australian Competition and Consumer Commission (ACCC) has accepted a court enforceable undertaking from Golf Imports Pty Ltd after the company admitted to engaging in resale price maintenance. This practice involved prohibiting retailers from selling its products below a specified price, which is a violation of Australian competition law.
Golf Imports, an importer and wholesaler of golf equipment, supplies well-known brands such as Callaway to major retailers including Drummond Golf, GolfBox, and Golf World. The company acknowledged that between April 2022 and July 2025, it included clauses on its website that restricted retailers from advertising its products below a set price.
Under Australian competition law, it is illegal for suppliers to prevent resellers from advertising or selling goods below a minimum price. ACCC Deputy Chair Catriona Lowe emphasized the importance of price competition in the market economy, stating that resale price maintenance can lead to higher prices and significant consumer harm, especially during times of increased living costs.
The illegal clauses were part of Golf Imports’ Online Policy and Supply Agreement, which threatened to suspend or terminate retailers' ability to sell goods if they did not comply with the pricing restrictions. Although Golf Imports did not actively enforce these clauses, the undertaking requires the company to remove them, inform customers of the changes, and implement a compliance program for three years.
Golf Imports, established in 2006, is the exclusive Australian distributor for several golf brands and has a product guide featuring over 100 pages. The ACCC has previously taken action against other companies for similar violations, highlighting the seriousness of resale price maintenance in the industry.
