On June 5, 2025, the Board of Directors of the Competition Authority, in the exercise of the powers conferred upon it by paragraph d) of paragraph 1 of article 19 of the Statutes, approved by Decree-Law no. 125/2014, of 18 August, decides to adopt a decision of non-opposition to the concentration operation, under the terms of paragraph b) of number 1 of article 50 of the Competition Law, since it is not susceptible to create significant impediments to effective competition in the national market or in a substantial part of it.

Portuguese Competition Authority Approves DAMM and Nestea Merger

On June 5, 2025, the Board of Directors of the Portuguese Competition Authority (AdC) made a significant decision regarding the merger between DAMM and Nestea, designated as merger 32/2025.

 Utilizing the powers granted by the relevant statutory provisions, the AdC concluded that the merger does not pose a threat to effective competition within the national market or any substantial part of it. This decision was made under the guidelines of the Competition Law, specifically referencing the criteria for assessing concentrations.

 The non-opposition decision indicates that the merger is unlikely to create significant barriers to competition, allowing both companies to proceed with their plans without further regulatory hurdles.
