Spanish Competition Authority Investigates Anticompetitive Practices in Insurance Sector
The Spanish competition authority, CNMC, is investigating potential anticompetitive practices in the insurance market, focusing on agreements among insurers and brokers.

The Comisión Nacional de los Mercados y la Competencia (CNMC) is conducting an investigation into possible anticompetitive practices within the insurance sector. This inquiry targets insurance companies and brokers suspected of engaging in collusive behavior.
Specifically, the CNMC is examining potential agreements or coordinated practices related to coverage in claims for damages, the exchange of client information, and the fees paid to various professionals, including possible restrictions on certain professionals.
If confirmed, these practices could violate Article 1.1 of the Spanish Competition Law (LDC) and Article 101 of the Treaty on the Functioning of the European Union (TFUE).
As part of the investigation, CNMC officials conducted inspections at several insurance companies' offices from February 24 to 26, 2026. These inspections are a preliminary step in the investigation process and do not imply any presumption of guilt regarding the companies involved.
Should these practices be deemed serious violations of competition law, they could result in fines of up to 10% of the total turnover of the infringing companies from the previous financial year.
