Polish Competition Authority Investigates Energy Practices
The President of the Polish competition authority has initiated an investigation into the practices of the Polish Power Grid Company regarding the management of renewable energy sources.

The President of the Polish competition authority, Tomasz Chróstny, has launched an explanatory proceeding concerning the practices of the Polish Power Grid Company (PSE). The investigation focuses on the mechanism of redistributing energy production from renewable sources and energy storage.
Concerns have been raised about whether some energy producers are being treated unfairly. PSE, as the sole operator of the electricity transmission system in Poland, holds a dominant market position, which must not be abused under antitrust law.
One method of balancing electricity supply and demand involves the non-market mechanism of redistributing renewable energy sources (RES). This can lead to temporary shutdowns or limitations on RES installations, potentially harming the revenue of energy producers.
Complaints have been received from RES producers alleging that their installations are disproportionately subjected to this redistribution mechanism compared to others, which could disadvantage them in the market. UOKiK is examining whether PSE's orders to reduce or halt electricity production were issued in a proportional, uniform, and non-discriminatory manner.
President Chróstny emphasized that while the role of PSE in ensuring the stability of the electricity system is acknowledged, the investigation aims to ensure that the redistribution mechanism is applied transparently and equitably.
Issues related to redistribution are relatively new in the Polish market, stemming from the rapid growth of RES capacities, particularly among prosumers. The President of UOKiK aims to support the regulation of redistribution practices to ensure fair competition conditions for all businesses.
