During the oversight process, the authority analyzed contracts and practices of various companies, gathered opinions from market participants, and considered explanations and changes made during the proceedings.

Helena Tipka, the service manager at Konkurentsiamet, stated that the investigations provided valuable insights into the practices within the retail sector and highlighted areas where market participants require greater legal clarity. Key issues addressed included various fees, the use of offsetting, and other contract terms that may raise compliance questions with fair trading regulations.

Konkurentsiamet expressed gratitude to market participants for their cooperation and explanations during the investigations. The authority believes that clear and balanced trading relationships support the functioning of the agricultural and food supply chain, benefiting both consumers and the Estonian economy.

As a result of the investigations, Konkurentsiamet has established positions on several important issues, including non-sales-related fees, the potential transfer of buyer business risks to sellers, the use of offsetting, and the transparency of contract terms. The authority has created guidance materials to help businesses proactively assess their practices and ensure compliance with fair trading regulations, which are publicly available on their website.
