Spanish Competition Authority Supports Adif's Capacity Offer for New Rail Corridors

The Spanish competition authority, CNMC, has positively evaluated Adif's capacity offer aimed at liberalizing three new rail corridors, ensuring transparent access for companies.

The CNMC (Comisión Nacional de Mercados y Competencia) has released a report on the update of the Declaration regarding Adif's network and Adif Alta Velocidad (AV). This report outlines the procedure for allocating framework capacity over several years for the new corridors: Madrid-Galicia, Madrid-Asturias/Cantabria, and Madrid-Cádiz/Huelva.

The Declaration is crucial for railway companies as it details the characteristics of Adif's infrastructure, ensuring transparent and non-discriminatory access to the network. Adif's first capacity offer was made in 2019, coinciding with the liberalization of other corridors.

The CNMC has expressed approval that Adif will not initially specify the prioritization criteria for access requests to the new corridors. This approach allows interested companies to apply without being influenced by predetermined conditions. The CNMC will review and approve Adif's proposed criteria before the prioritization phase begins.

Framework agreements for capacity reservation are vital for companies planning specific investments, especially for high-speed lines. If only Renfe, the historical operator, requests capacity, Adif will not sign a framework agreement, ensuring that other companies can operate on these routes in the future.

Additionally, Adif is required to simplify some information requirements that were deemed excessive, which were not present in the 2019 capacity offer that significantly increased available capacity.

According to the Railway Sector Law, administrators must publish their Activity Programs, detailing planned actions on the network for the next five years. The latest programs, approved in February 2024, cover the period from 2022 to 2026 and have not been updated.
