Balearic Authority's Unjustified Demand for Free DAB+ Services

The Balearic Agency for Digitalization and Telecommunications has mandated the provision of free DAB+ radio services, which the CNMC deems unjustified and in violation of market unity regulations.

The Balearic Agency for Digitalization, Cybersecurity, and Telecommunications has issued a requirement for the provision of free digital audio broadcasting (DAB+) services. This includes expanding audio services to utilize all available technical capacity and providing technical services to other entities.

According to the CNMC, these services are not merely ancillary but are central to the contract. Requiring them to be offered for free places a financial burden on the awarded company, making it difficult for them to recover their investment and negotiate with future private radio stations.

The CNMC has stated that these demands are unjustified and violate Articles 3 and 5 of the Law on Guarantee of Market Unity (LGUM), which aims to ensure fair competition and prevent practices that could harm market dynamics.
