The President of the Polish Office of Competition and Consumer Protection (UOKiK) has released new guidelines on the calculation of fines for participating in anticompetitive agreements and abusing dominant positions, in line with the ECN+ directive. The guidelines clarify factors influencing fine amounts, such as the length of the violation, the type of practice, and market effects. They also address mitigating circumstances like cooperation with the authority and aggravating factors such as leading a cartel. The guidelines aim to provide transparency and ensure fines are proportionate to the infringement, with the President having the discretion to adjust fines in exceptional cases. These guidelines are particularly relevant for entities within complex capital groups and international corporations.
