The Slovak Competition Authority (Rada PMÚ) issued two decisions on April 13, 2026, modifying previous rulings against AGB ekoservis s.r.o. and Websupport s.r.o. for their refusal to submit information required during an investigation into a possible cartel agreement concerning the management of hazardous waste from healthcare facilities.
During an inspection at AGB ekoservis, the authority found only communications from the period immediately before the inspection. It was later discovered that a significant amount of deleted communications was still available at Websupport, a company providing hosting and domain services. The PMÚ requested this communication from both companies, but neither complied, leading to the conclusion that they violated their obligations under competition law.
The PMÚ determined that the companies' actions significantly hindered its ability to perform its duties effectively. The authority emphasized that all businesses are required to provide any necessary information and documents in any form, not just those under investigation, but also other entities that may possess key information.
In the case of Websupport, the PMÚ modified the initial decision to resolve discrepancies between the reasoning and the ruling but maintained the fine at €60,100. For AGB ekoservis, the PMÚ adjusted the initial ruling regarding the fine, reducing it to €52,800.
The decisions against AGB ekoservis and Websupport became final on April 22, 2026, and April 21, 2026, respectively. The parties involved may seek judicial review of these decisions.
