The Federal Trade Commission (FTC), led by Chairman Andrew N. Ferguson, has sent letters to 24 of the largest healthcare services companies in the U.S., emphasizing their legal duty to provide timely and accurate pricing information for healthcare services. This initiative is part of the FTC's ongoing efforts to enhance healthcare affordability and price transparency for consumers.

The letters express concerns that these companies may be violating the FTC Act by not offering transparent pricing, especially for routine and non-emergency medical care that is scheduled in advance. The lack of clear pricing can hinder patients' ability to make informed decisions and comparison shop, ultimately harming both consumers and competition.

Healthcare costs are a significant burden for American families, yet patients often commit to care without knowing the costs, which can vary widely between facilities. The letters highlight that when patients are not informed of the true price beforehand, it creates an unfair competitive environment for providers who are transparent about their pricing.

While the Centers for Medicare & Medicaid Services (CMS) have established price transparency rules, compliance with these does not exempt healthcare facilities from their obligations under the FTC Act. The letters clarify that failing to disclose prices can be considered deceptive if it misleads consumers, and incomplete disclosures can also be misleading.

Chairman Ferguson has urged healthcare companies to review their pricing practices and make necessary corrections. The FTC has prioritized tackling deceptive practices in the healthcare sector, as evidenced by recent actions, including a lawsuit against Lens.com for misrepresenting contact lens prices.
