UOKiK President fined Atex for nearly 2.5 million PLN for imposing coal sales prices on distributors, restricting their ability to offer discounts.

UOKiK President Tomasz Chróstny fined Atex for price-fixing in coal sales, affecting distributors who were supposed to have pricing independence. Atex, a coal importer and distributor, imposed prices on distributors, violating competition law by not allowing them to set their own prices or offer discounts. The decision serves as a warning to the market that labeling agreements as agency agreements does not exempt from competition law. The maximum penalty for participating in anti-competitive agreements is 10% of turnover, with fines up to 2 million PLN for directly responsible managers. The leniency program offers the chance to reduce or avoid penalties by cooperating with UOKiK as a whistleblower.
