Fine Imposed on Building Contractors for Cartel in School Outdoor Area Tender Process

Two building contractors in the Netherlands, Den Ouden and Bloem Infra, were fined for secretly exchanging bids in a cartel arrangement during the tender process for a school's outdoor area construction project.


In the case involving Den Ouden and Bloem Infra, the Netherlands Authority for Consumers and Markets (ACM) imposed fines due to their anti-competitive behavior of distorting the tender process for the school project in Roermond. Den Ouden avoided a fine by confessing first, while Bloem Infra cooperated and received a reduced fine. The companies engaged in 'cover pricing,' leading to fewer competitive bids and a delay in the project for the school, Yuverta. ACM ensures fair tender processes and works with PIANOo to advise contracting authorities. Companies involved in cartels can confess for leniency, with the first confessing company avoiding fines entirely.
